How PeraNest operates, protects your data, and works as a record-keeping platform - in line with Philippine law.

These Terms govern your use of the PeraNest platform, whether you are a group administrator, a funder, or a merchant.
By accessing or using PeraNest ("the Platform") through our web dashboards or mobile app, you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These Terms form a binding agreement between you and PeraNest OPC.
PeraNest is a record-keeping, management, and matchmaking platform for community savings and lending groups (paluwagan) and for a crowdlending marketplace. PeraNest is NOT a bank, lending company, financing company, investment house, or financial advisor. PeraNest does not hold, transfer, custody, or manage funds. All money moves directly between users through their own payment channels. PeraNest only records transactions that users enter.
Group administrators are solely responsible for verifying their members and contributions, approving or rejecting loans at their own discretion, collecting and disbursing money through their own channels, the accuracy of data they enter, and complying with all applicable laws, including tax, lending, and data privacy obligations. PeraNest does not verify the accuracy of data entered by users.
Funders participate in the merchant marketplace using their own funds only - never funds belonging to a savings group or its members. Each funding decision belongs to the funder alone. Risk scores and analytics are informational only and are not a recommendation, guarantee, or assurance of repayment. See the Funder Risk Disclosure below.
Merchants agree to provide true, accurate, and complete information; upload genuine documents; use funds for the stated business purpose; and repay funders on the agreed terms. Submitting false information may constitute fraud and may result in termination and legal action. Repayment obligations are owed directly to funders, not to PeraNest.
Certain features require a paid subscription. Fees, billing cycles, funding caps, and applicable taxes are disclosed at the point of purchase. Subscriptions renew per the plan selected. Refunds are governed by our refund terms and the Philippine Consumer Act (RA 7394).
You agree not to use the Platform for any unlawful purpose, to submit false or misleading information, to launder money or finance illegal activity, to access accounts or data you are not authorized to access, to reverse-engineer or disrupt the Platform, or to share your credentials. We may suspend or terminate accounts that violate these terms.
Nothing on the Platform constitutes financial, investment, legal, or tax advice. PeraNest does not guarantee any return, does not insure any deposit or advance, and does not enforce loan or funding limits. All financial decisions are made at your own risk and discretion.
The Platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law, PeraNest is not liable for financial losses arising from group or marketplace activity, disputes between users, inaccurate data entered by users, service interruptions, or the actions of administrators, members, funders, or merchants. Our total aggregate liability shall not exceed the fees you paid to PeraNest in the twelve (12) months preceding the claim.
You may stop using the Platform at any time, subject to any outstanding obligations to other users, which survive termination. We may suspend or terminate access for breach or suspected fraud. Financial records may be retained after termination as required by Philippine law.
These Terms are governed by the laws of the Republic of the Philippines. Disputes shall be resolved in the proper courts of the Philippines.

↑ Back to topHow we collect, use, and protect personal data, in compliance with the Philippine Data Privacy Act of 2012 (RA 10173).
For a group's member data, the administrator is the Personal Information Controller and PeraNest acts as Personal Information Processor. For your own account data, and for merchant accounts, PeraNest is the Controller.
Account data (name, email, phone, password); group and member records (contributions, loans, payments, distributions, scores); merchant profile and documents (business details, registration numbers, IDs, permits, statements); marketplace activity (fundings, offers, repayments); and technical data (device, browser, IP address, usage logs) to operate and secure the Platform.
To provide and maintain the Platform, process the records you enter, display marketplace listings and verification status, calculate informational scores, secure accounts and prevent fraud, send service notifications, and comply with Philippine law. We do not sell personal information.
We share data with service providers who help operate the Platform (hosting, email, analytics) under confidentiality obligations; with marketplace counterparties as needed to complete a funding; and with law enforcement or regulators when required by valid legal process. Sensitive identifiers are minimized and not displayed to other users.
We use encryption in transit and at rest, access controls, short-lived authentication tokens, tenant isolation so each group's data is segregated, and audit logging for financial operations. All monetary calculations use precise decimal arithmetic.
Under RA 10173 you have the right to be informed, to access, to correct, to object to processing, to erasure or blocking, to data portability, and to damages. To exercise these rights, contact our Data Protection Officer at dpo@theperanest.com. We respond within the period required by law.
We retain financial records while your account is active and for a minimum period after closure as required by Philippine financial and tax regulations. You may request deletion of data not subject to a legal retention obligation.
We may update this Policy. Material changes are notified in-app or by email, and continued use after the effective date constitutes acceptance.

PeraNest operates in alignment with: RA 10173 (Data Privacy Act of 2012); RA 10175 (Cybercrime Prevention Act); RA 8792 (E-Commerce Act); RA 11765 (Financial Products and Services Consumer Protection Act); and applicable BSP, SEC, and NPC issuances.
We process personal data under the principles of transparency, legitimate purpose, and proportionality. We have appointed a Data Protection Officer and, where required, register our data processing systems with the National Privacy Commission (NPC).
Encryption at rest and in transit, role-based access control, short-lived JWT authentication, tenant isolation so each group's data is segregated, account-scoped document storage, database-level audit trails for financial operations, and regular vulnerability review.
Documents uploaded by merchants (government ID, business registration, permits, statements) support identity and business verification consistent with the Anti-Money Laundering Act (RA 9160, as amended). PeraNest does not process funds, but administrators and funders are responsible for verifying the legitimacy of members and merchants.
In the event of a personal data breach posing real risk of harm, we will notify the NPC and affected users within the period required by law and document remedial actions taken.

Merchants may repay late, partially, or not at all. PeraNest does not guarantee repayment and does not compensate you for losses.
PeraNest connects you with merchants and records the transaction. PeraNest is not a party to the funding agreement, does not lend, does not hold your money, and does not collect on your behalf. The funding relationship is directly between you and the merchant.
You must fund only from your own personal or business funds. You must NOT use funds belonging to your savings group, its members, or any third party.
Merchant risk scores, flags, and analytics are generated from limited platform data and self-declared information. They may be inaccurate or incomplete and are not a recommendation or guarantee of creditworthiness. You are responsible for your own due diligence.
Funding activity may be subject to Philippine laws including the Lending Company Regulation Act (RA 9474), SEC crowdfunding rules, and the Financial Products and Services Consumer Protection Act (RA 11765). You are responsible for ensuring your participation complies with laws applicable to you.
By funding a merchant you acknowledge that you have read and understood this disclosure, that you accept the risk of loss, and that PeraNest is not liable for the outcome of your funding decision.

The PeraNest name, logo, design, source code, and documentation are owned by PeraNest OPC and protected under the Intellectual Property Code of the Philippines (RA 8293). You may not copy, modify, distribute, sell, or lease any part of the Platform without prior written consent.
You retain ownership of the data and content you submit. By submitting content you grant PeraNest a non-exclusive license to use and process it solely to provide the service, including display of marketplace listings to funders. You represent that you have the right to submit it and that it does not infringe any third party's rights.
If you believe content on the Platform infringes your intellectual property, send a notice to legal@theperanest.com with your contact details, a description of the work, the location of the infringing content, a good-faith statement, and your signature. We respond to valid notices within 10 business days.
"PeraNest" and the PeraNest logo are trademarks of PeraNest OPC. Other marks are the property of their respective owners. Use of our marks without written permission is prohibited.
